Search Berkeley County Dockets

Start a Berkeley County docket search by figuring out which court holds the case. Circuit matters and magistrate matters sit in separate statewide tools, while municipal and federal cases take other routes. With a name or case number, a Berkeley County case search can surface public docket entries, court dates, and case events. Want a filed or certified document? Ask the proper clerk. Keep in mind that public results are not the official record, and restricted matters may return little or nothing. The court and clerk remain the final sources.

Choose a Berkeley County Docket Court

A name alone gets you nowhere until you know the court level. The West Virginia court record access page splits the routes. It sends Circuit Court users to WVPASS. Magistrate Court users go to MCR. Berkeley Circuit Court holds felony trials, major civil matters, and lower-court appeals. Berkeley Magistrate Court takes misdemeanors and traffic cases. It also handles preliminary felony matters and civil claims within its authority. Family Court records stay with the Circuit Clerk, though family material has limited access.

Martinsburg Municipal Court offers no public city search form through official channels. For a Martinsburg ordinance or city traffic case, start with the citation and appearance date. Then use a direct call or counter visit. Federal matters in the Northern District of West Virginia run through PACER or CM/ECF. The Berkeley County land-record portal covers deeds and real-property records. It does not carry state court dockets.

Name-Based Case Searches

WVPASS gives public Circuit Court information three routes: Name, Case, and Attorney. For a Berkeley County name search, type the party name first. Then pick Berkeley County. Narrow by case type, status, or created-date range as those controls appear. A common name can drag in unrelated people. County and date filters help separate records. A shared name does not mean the right case.

  1. Open WVPASS and choose the Name route for a circuit matter, or pass the MCR acknowledgement gate for a magistrate matter.
  2. Enter the name as the live form accepts it. Add Berkeley County, case type, status, or dates when available.
  3. Compare court location, case number, filing date, and case type before opening a result.
  4. Read the case header, hearings, entries, and disposition in order. Verify the record with the filing clerk when accuracy matters.

Berkeley County MCR Search Limits

The Magistrate Case Record Search opens with a disclaimer. You must click an acknowledgement marked “Click to continue.” A challenge follows. From there you can search by first and last name or by case number. Results stop at 30 records. That cap makes a broad name search incomplete, especially when one name spans several counties.

The official judiciary instructions say what MCR can display. It lists filing date, charge, disposition, and documents. Online document images are not promised. Set the location to Berkeley, and refine with an exact number where you can. Contact the Magistrate Clerk when a listed document is needed. The judiciary's MCR instructions lay out the public scope and the result limit:

Why the clerk still matters: this boundary keeps the Magistrate Clerk as the document source after any Berkeley County docket search.

Case Number Searches

An exact case number usually beats a common name. WVPASS asks for Berkeley County and offers case type, year, and number fields as available. Its application models show more than one arrangement. There is no single safe circuit format. Enter the identifier exactly as it appears on the notice, pleading, or court receipt.

MCR and the Magistrate Fine Payment system use formats like ##-M##X-##### and M##M-##########. Dashes matter in the payment portal. A citation ID is its own exact identifier. A payment-plan ID can look like MC##-#####. The fine portal locates an assessed account, not the full Berkeley County court docket.

Search tip: If WVPASS reports an invalid number, recheck the county, year, type, sequence, extension, and punctuation against the court document.

WVPASS Narrows Berkeley County Docket Results

The WVPASS case system opened for public use in 2025. Searching and registration are free. The name route can filter by party class and county. Type, status, and dates round it out. The case route leans on county, type, year, and number. Attorney search is a third route, not a substitute for a party search.

Validation messages point you to the field needing repair. Look for Missing Name, Missing County, Invalid Number, and incomplete date ranges. Dynamic lists change, so the live form controls overrule any saved instructions. Once a result appears, downloads are not free. Public document downloads cost 25 cents per page plus a card-processing fee. Sealed filings and juvenile matters are excluded. The official MCR entry gate shows the acknowledgement step on the magistrate branch:

Next step: passing that gate starts the search, but the clerk must validate any unclear Berkeley County result.

Case Search Results Explained

A result row only flags a possible match. The detail view puts the case in context. Read the location and case number first, then case type, filing date, status, and the assigned judge or magistrate. Parties and attorneys appear where public. A chronological register lists filing dates, codes, descriptions, and filers. Hearing blocks may show date, time, location, judge, event type, and status.

Disposition fields can state a plea, dismissal, judgment, or another outcome. Financial fields may show costs, fines, judgment sums, interest, or payments. One caution: a motion is not a ruling. Find the later order or judgment. And an event marked closed means that event ended, not necessarily that the whole case did.

Case numberThe court's unique identifier; enter the exact printed format.
Case type and dateThe category and the date the clerk accepted the case.
Parties / attorneysPublic participants and counsel linked to the matter.
Docket entriesDated filings, notices, orders, and other court events.
HearingsDate, time, location, judge, setting type, and event status when recorded.
DispositionThe recorded outcome, which should be checked against the signed order.

Berkeley County Search Versus Documents

Searching a Berkeley County docket and ordering a paper copy are separate steps. WVPASS opens the public circuit search for free. Document images carry a per-page charge once you download them. MCR shows magistrate case details and lists what was filed. Copies usually come from the Magistrate Clerk. One more caution: a downloaded image is not a clerk-certified copy of the court record.

Need circuit or family papers instead? The Circuit Clerk's office runs free public terminals during regular hours. Bring a case number plus a filing date or document name. Plain circuit photocopies run one dollar per page. The official pages list no certified-copy fee and promise no turnaround. Call before you mail funds. Confirm what identification and payment method the clerk accepts.

Note: The portal summarizes public data. The filing clerk maintains and certifies the official Berkeley County record.

Two Ways to Search: County and State

No Berkeley County site hosts its own circuit case database. Both search tools here are statewide systems that split the local courts between them. WVPASS handles public circuit case and document lookup. MCR covers magistrate case information. The county clerks fill the gap. They offer courthouse terminals, counter help, phone confirmation, and written copy requests for any Berkeley County court docket you cannot pull online.

Statewide online routeBerkeley County local route
WVPASS for public Circuit Court cases and available documentsCircuit Clerk terminal and counter for circuit and limited family access
MCR for Magistrate Court case informationMagistrate Clerk for validation and documents
Free searches, with WVPASS document chargesClerk copy fees and access rules apply

City and federal courts sit outside both systems. Martinsburg Municipal Court fields its own citation and hearing questions, and PACER covers the federal side. Pick the right court first. A search run in the wrong branch can hand you a false "no record" answer.

Older Berkeley County Docket Searches

WVPASS states that public circuit documents reach back to 1999. That mark describes portal coverage. It is not a destruction date. Berkeley County court records may still live in paper files, bound books, index cards, microfilm, or later scans. Historic court functions also shifted among county buildings as the courthouse complex grew.

An older name search may come up empty. In that case, give the Circuit Clerk the court, the approximate year, party names, and the item you want. Ask whether an archive or manual index search applies. Put the case number in any written request when you have it. Say whether you seek inspection, a plain copy, or certification. Do not swap in the County Clerk land-record system for a court docket search.

Which Cases Stay Restricted

A blank result can mean restricted access. It may not be a failed search. WVPASS leaves out sealed filings and juvenile matters. West Virginia Family Court Rule 6 shields pleadings, exhibits, recordings, and transcripts. Family orders and indices generally stay public. State law treats juvenile records as outside the ordinary public record. An expungement order can remove or seal a docket entry too.

Start with the right court. Use the exact case number. Then ask the clerk about the case. It may be municipal, older than portal coverage, sealed, expunged, juvenile, or family-restricted. Authorized parties should ask what proof of identity, authorization, or court order the clerk requires. For divorce files, the Berkeley Circuit Clerk wants parties to show photo identification in person. Remote access needs notarized authorization plus a notarized copy of identification.

Access boundary: A public docket search does not override a seal, confidentiality rule, or statute. Request only the access procedure that applies.
