Data You Give Us Directly
Search Queries
A name, case number, or other term entered in a search box is sent directly to the outside company that operates the tool. That provider processes the query and supplies its results. Berkeley County Court Docket does not keep or log those search terms on its own systems.
Messages and Contact Submissions
An email or other direct message may be retained as needed to answer it and maintain related records. Such correspondence is kept within the operating team unless disclosure is required by a valid legal duty.
Data We Gather Automatically
When a page loads, servers may automatically receive basic technical and activity information about the visit:
- The device's assigned IP address
- Browser name and version
- Operating system and device category
- Pages viewed and time spent on them
- The referring site, when available
- The date and time of each request
Cookies and Analytics
Cookies are small files placed on a device. They and analytics services help measure aggregate use, including popular pages and the points where visits end. A browser can block or remove cookies through its settings. Some functions may work differently after cookies are disabled.
What We Do With This Data
- Operating, maintaining, and improving site performance
- Routing a submitted query to the selected search provider
- Measuring which reference pages visitors use
- Finding and correcting service or security problems
- Displaying advertising that may reflect visitor interests
No Court-Record Data on File
Berkeley County Court Docket does not host, maintain, compile, or sell a database of court dockets or personal case information. It publishes general directions to WVPASS, MCR, the Berkeley County clerks, and the courts that hold the original files. The site is not a consumer reporting agency under the Fair Credit Reporting Act. Visitor information is not assembled into a consumer report or a record about another person.
Third-Party Search Partners
Outside companies power search boxes displayed on the site. Information placed in a partner tool is governed by that company's privacy policy rather than this policy. The partner decides how long it retains data and when it shares data. Review those terms before sending a query.
Links to Other Websites
Links may lead to Berkeley County clerk pages, West Virginia court systems, legal resources, or outside search services. After a visitor follows one of those links, the destination's policy governs the visit. Its terms should be reviewed before personal details are disclosed.
Advertising providers may use their own technology to measure activity across websites and select ads. Their systems control that tracking.
Who Might See Your Data
Personal data is not sold. Limited information may be disclosed to:
- Search providers that process a query submitted to their tool
- Analytics vendors that measure site traffic and performance
- Advertising networks that deliver ads
- Government or law-enforcement authorities when valid legal process requires disclosure
How We Protect Your Data
Reasonable, commonly used safeguards protect information in the site's control. No internet service can guarantee perfect security, however, and no promise can be made that loss, misuse, or unauthorized access will never occur.
Users Under 18
The site is intended for adults and does not knowingly collect personal information from anyone under 18. If information from a minor is identified, it will be deleted after the operator receives sufficient notice.
Your Data Rights
Rights can vary with a visitor's location and applicable law. The West Virginia Freedom of Information Act, W. Va. Code ยง29B-1-4, governs access to qualifying public records held by public bodies. It does not turn this private site into a public agency or create access to sealed court material. Subject to applicable law, a visitor may:
- Request access to personal information held about that visitor
- Ask that inaccurate information be corrected
- Request deletion when the law permits it
- Object to or opt out of certain processing when a right applies
Updates to This Policy
This policy may be revised as practices or legal duties change. A revised version will be posted here and identified by a new effective date. Continued use after publication is subject to the updated policy.
